The International Criminal Court (ICC) has ruled that former Philippine President Rodrigo Duterte is fit to stand trial over alleged crimes against humanity linked to his administration’s controversial anti-drug campaign.
The ICC’s Trial Chamber III made the decision public on Thursday, October 8, 2026, following an assessment by an independent panel of medical experts.
According to the court, the expert panel unanimously found that Duterte has the capacity to understand the charges against him, follow the proceedings, understand the evidence and instruct his lawyers in preparing and conducting his defence.

The judges said they were satisfied that Duterte would be able to effectively exercise his fair-trial rights.
Trial Set to Begin November 30
The ICC has scheduled the opening of Duterte’s trial for November 30, 2026.
The court also ordered that his health continue to be monitored by the medical officer at the ICC detention centre. The judges said any significant changes in his medical condition must be reported to the Chamber.
The ruling follows arguments from Duterte’s defence team that his health and alleged memory problems affected his ability to understand and participate effectively in the proceedings.
The ICC, however, accepted the findings of the independent expert panel and determined that he can participate in the trial.
Duterte Faces Crimes Against Humanity Charges
Duterte is facing three counts of crimes against humanity arising from alleged killings connected to the anti-drug campaign carried out during his time as president and, according to the ICC case history, earlier periods covered by the court’s investigation.
The ICC confirmed the charges in April 2026 and committed Duterte to trial before a Trial Chamber. The case subsequently moved to Trial Chamber III, which scheduled the trial to begin on November 30.
Duterte has denied wrongdoing and has defended his anti-drug campaign. His legal team has challenged the case, including on medical grounds.
The fitness ruling does not determine whether Duterte is guilty or innocent. It only establishes that, according to the court’s assessment, he is capable of participating meaningfully in the proceedings.
Duterte’s Arrest and Transfer to The Hague
The ICC issued an arrest warrant for Duterte in March 2025. He was surrendered to the court on March 12, 2025, and transferred to the ICC’s detention centre in The Hague.
His initial appearance before the court took place on March 14, 2025.
The confirmation of charges hearing was held from February 23 to 27, 2026. On April 23, 2026, the ICC’s Pre-Trial Chamber confirmed all three crimes against humanity charges brought by prosecutors and committed Duterte to trial.
Duterte later appeared in the ICC courtroom in September 2026 as the court considered whether he was fit to face trial.
With the latest ruling, the case can now proceed toward the scheduled trial opening in November.
Controversial Anti-Drug Campaign
Duterte’s war on drugs was one of the defining policies of his presidency, which lasted from 2016 to 2022.
Thousands of people were killed during the campaign, although estimates of the total death toll vary significantly depending on the source and methodology used.
Philippine authorities have reported thousands of deaths in anti-drug operations, while human rights organisations have cited substantially higher figures, including deaths allegedly involving police and unidentified armed groups.
ICC prosecutors allege that Duterte was responsible for crimes against humanity committed as part of the campaign. Those allegations will be tested during the trial.
Duterte has consistently denied the allegations against him and maintained that his actions were aimed at fighting illegal drugs and protecting the public.
What Happens Next?
The next major stage of the case will be the opening of the trial on November 30, 2026, when prosecutors will begin presenting their case against the former Philippine president.
The proceedings are expected to attract international attention because Duterte is among the highest-profile former national leaders to face proceedings before the ICC.
The case remains ongoing, and no verdict has been reached. Duterte remains presumed innocent unless and until the court determines otherwise.
